Marketing Override Terms

Version 2026-09-20.1 · last updated 20 September 2026 · integrity hash 7e941012e85c858b

What this is

vGuest refuses to send marketing messages to contacts who have no recorded consent when a business runs in consent-required mode. A business can still proceed by accepting the terms below inside the send dialog. When it does, vGuest records who accepted, when, from where, the number of contacts involved and the exact version of this text, and keeps that record as evidence. Contacts who asked to stop receiving marketing are never included, whatever the business accepts.

The version and hash above are what the app stores with every acceptance, so a recorded acceptance can always be checked against the text published here.

Sending marketing messages to contacts with no consent record in vGuest

On behalf of the business I confirm that:

  1. 1. Every recipient of this send has a lawful basis to receive advertising under Section 30A of the Israeli Communications Law (Bezeq and Broadcasts), 1982 - explicit consent given to the business, or an existing customer relationship in which the details were provided, notice of marketing use was given and an opportunity to refuse was offered.
  2. 2. The business, not vGuest, is the advertiser and sender of these messages and bears full and sole responsibility for any claim, demand, fine or compensation arising from this send, including claims under the anti-spam law and the Protection of Privacy Law.
  3. 3. I understand that vGuest provides the platform only, recommends sending marketing only to recipients whose consent is recorded, and will record this acceptance (who accepted, when, number of recipients and terms version) as evidence.
  4. 4. Recipients who asked to be removed are never included in this send, and this acceptance does not apply to them.

Service vs marketing - how vGuest draws the line

A message is marketing when its purpose is to encourage spend, and any promotional element makes the whole message marketing. Service messages about an existing booking never need marketing consent and are never held back by an opt-out. The category of a WhatsApp template comes from Meta's own classification, not from the sender.

MessageCategoryWhy
Booking confirmation, change, cancellationServiceTied to a specific existing booking
Pre-arrival info, check-in link, directions, Wi-FiServiceThe stay the guest already bought
In-stay notices about that stay (pool hours, checkout time)ServiceSame stay
Reply to what the guest askedServiceRequested
"The room you asked about opened up" - guest asked to be toldServiceWritten request = consent limited to that request
Satisfaction survey or review request with no offer attachedServiceFeedback is not advertising unless an offer is added
Win-back, "we miss you", "book again"MarketingEncourages new spend
Upsell during the stay for a fee (spa, upgrade, late checkout)MarketingMeta: upsell is marketing even mid-stay
Holiday deals, seasonal offers, any broad list sendMarketingAdvertising
Survey or review request with a couponMarketingA promotional element taints the whole message
Birthday greeting with a discountMarketingThe discount
Price-drop alert the guest did not ask forMarketingNot tied to a written request
Newsletter, events, blog digestMarketingAdvertising

Rule of thumb: if you removed every promotional word and the message would no longer be worth sending, it is marketing. Questions: info@vguest.ai. See also our Privacy Policy and Terms of Service.
